📋Definitions

  • "Entrant": A person who enters the competition.

  • "Competition": The specific prize draw listed on the Website.

  • "Website": The promoter's website, https://www.duckdash.uk/.

  • "Draw Date": The date the winner is selected.

  • "Opening/Closing Date": The start and end dates for a competition.

22. The Competition

2.1 These terms and conditions apply to all competitions listed on the Promoter's website at https://www.duckdash.uk/ (the "Website").

2.2 All competitions are skill-based. Online entries require payment each time you enter. Where the Promoter offers an easy or multiple choice question, a free entry option is available.

2.3 To be eligible to win, each Entrantmust correctly answer a question or solve a problem set by the Promoter (the "Competition Question").

33. How to Enter

3.1 Competitions run from the specified Opening Date until the Closing Date displayed on the Website. All times refer to London, England time.

3.2 Competition closing dates may change if all ducks for a given competition have been allocated. The Promoter reserves the right to end a Competition early; in such an event, the draw will take place on the specified Draw Date, and the Promoter will provide at least 24 hours' notice of the new closing time on the Website. The Promoter will not extend the Closing Date to sell more entries.

3.3 Entries must be received by the Closing Date and time. Late entries may be disqualified without refund. Instant win entries are non-refundable under any circumstance.

3.4 The maximum number of entries allowed per competition is stated on the Website. Entry limits may apply when this number is reached.

3.5 Entrants may submit multiple entries up to the maximum allowed. Free entries must be submitted separately. Bulk or automated entries will be counted as a single entry.

3.6 To enter online:

  1. aVisit the Website and view the Competition Question;
  2. bSelect your answer and the number of entries;
  3. cComplete the checkout and submit the registration form;
  4. dMake payment and receive confirmation;
  5. eRepeat as desired within entry limits.

3.7 All entries must be in English. Non-English entries will be disqualified with no refund.

3.8 Except for free entries, confirmation and ticket numbers will be sent to entrants.

3.9 The Promoter is not responsible for lost, delayed, or incomplete entries caused by technical failures or errors.

3.10 By entering, you agree to be bound by these terms.

3.11 Free postal entries can be made by sending a 1st class unenclosed postcard with the following details to:

Include: full name, address, telephone number, email, the competition entered, and your answer to the Competition Question. Hand-delivered entries will not be accepted, and bulk entries delivered in the same envelope will be counted as one single entry.

Multiple free entries are allowed if posted separately. Entries must be received before the Closing Date to qualify. Entrants must have an account on the Website, and postal entry details must match the registered account.

44. Choosing a Winner

4.1 Entrants who correctly answer the Competition Question will enter a random draw within 7 days of the Closing Date ("Draw Date").

4.2 Instant win numbers are randomly generated at checkout and prizes awarded immediately as per instant win rules.

4.3 Entrants' names and entry numbers may be published on the Website or shown during the live drawunless you notify the Promoter at least 48 hours prior to the draw via hello@duckdash.uk to opt out.

4.4 The draw will proceed on the specified Draw Date regardless of the number of entries received. There is no minimum number of tickets required for the draw to take place.

55. Eligibility

5.1 Open to UK residents aged 18 and over, excluding employees of the Promoter, their agents, suppliers, or immediate families. Entrants are responsible for ensuring that their participation in the competition is lawful in their country of residence. The Promoter will not be liable for any Entrant entering unlawfully.

5.2 By entering, you confirm eligibility to enter and claim prizes. The Promoter may request proof and can disqualify entrants failing to provide it.

5.3 No automated or incomplete entries accepted.

5.4 The Promoter reserves the right to disqualify entrants whose conduct breaches the spirit of the competition or is contrary to the intention of the competition. This includes any conduct that is abusive, racist, or defamatory.

5.5 The Promoter reserves the right to void any and all entries from an Entrant found to be using or operating multiple accounts. Entry fees for such voided entries will not be refunded.

5.6 No refunds of entry fees will be given, including if eligibility changes, entrants are disqualified or incorrectly answers the Competition Question.

5.7 Fraud, hacking, or unauthorized use of the Website will void entries and may prevent future participation.

66. The Prize

6.1 Prize details are on the Website and correct at the Opening Date.

6.2 Prizes are subject to availability. Substitutions of equal or greater value may be made if necessary.

6.3 The Promoter makes no representations and gives no warranties about the Prize, its value, or its condition, or any other information provided on the Website. The vehicle will be supplied with a valid MOT at the time of prize transfer, if applicable. Insurance, tax, and road legality are the Winner's responsibility; The Winner must have required licenses and safety equipment.

6.4 Prizes may be supplied by third parties; supplier details will be provided.

6.5 The Promoter may, at its sole discretion, substitute the prize with a cash equivalent if the original prize becomes unavailable or is no longer viable to award.

6.6 Prizes are non-negotiable and non-transferable.

6.7 For holiday/event prizes, travel details and exclusions are listed. Winners must ensure valid travel documents.

77. Winners

7.1 The Promoter's decision is final.

7.2 Winners' full names will be announced during the live draw unless privacy is requested 48 hours prior.

7.3 Winners will be contacted via provided details within 21 days. If unreachable, an alternate winner will be selected similarly.

7.4 The Promoter will publish winners' names and towns on the Website as proof of a valid draw.

7.5 Objections to publication must be sent to hello@duckdash.uk before the Closing Date.

88. Claiming the Prize

8.1 Prizes must be claimed personally. The Promoter will arrange delivery or collection of the prize with the Winner within 28 days of the Winner successfully claiming the prize.

8.2 Notify the Promoter promptly of any change in contact details via hello@duckdash.uk.

8.3 The Winner agrees that a condition of receiving a cash prize is to provide a photograph and/or short video of themselves with evidence of their win (e.g., a celebratory photo) for reasonable publicity, which the Promoter may use. Cash prizes will be paid 70% on verification and the remaining 30% upon the Promoter's receipt of the agreed publicity material.

8.4 The Promoter is not responsible if winners cannot or do not claim prizes.

8.5 Vehicle prizes will be transferred using V5 registration documents after eligibility checks.

99. Prize Payment, Verification, and Storage

9.1 Verification: All monetary prizes will only be paid directly into the verified personal bank account of the named winner. Under no circumstances will winnings be transferred to any third party. The winner must provide valid identification to confirm their identity and ownership of the bank account.

9.2 Storage: The Promoter can store a physical Prize free of charge for up to 30 days after notifying the Prize Winner. If the Prize needs to be stored for more than 30 days, this shall be at the cost of the Prize Winner, and such costs must be paid to the Promoter before the Prize is delivered or collected.

1010. Limitation of Liability

10.1 Except for liability for death or personal injury caused by the negligence of the Promoter, for fraudulent misrepresentation, or for any liability that cannot be excluded by law, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the supply of any goods or services as Prizes.

10.2 The total maximum aggregate liability of the Promoter to a Prize Winner shall be limited to the total value of the Prize that has been won.

10.3 The total maximum aggregate liability of the Promoter to an Entrant who is not a Prize Winner shall be limited to the amount that the Entrant has paid to enter Competitions in the preceding 12 months.

10.4 Your statutory rights remain unaffected.

1111. Data Protection and Publicity

11.1 Personal information is used only for administering the competition or as detailed in our Privacy Policy on the Website.

11.2 Winners consent to use of their name, image, and location for publicity unless they have opted out as per clause 4.3.

11.3 If you do not wish to be included in publicity, notify the Promoter before the Closing Date; this won't affect your chances of winning but may affect the process for claiming a cash prize as detailed in clause 8.3.

11.4 Further personal data may be requested to verify eligibility and transfer prizes.

11.5 Requests to opt out of marketing communications will withdraw you from the competition, with no refund.

1212. User Accounts

12.1 You must keep your account password secure and secret at all times. You must memorise your password and never write it down or tell it to anyone.

12.2 Your password and login details are personal to you and should not be given to anyone else. You must use a password which is unique to your account and maintain good internet security.

12.3 You must contact the Promoter immediately if you believe anyone apart from you has used your account without your permission.

12.4 The Promoter shall not be responsible for any consequences arising out of a breach of these rules by you.

1313. Use of the Website

13.1 You hereby agree that the Website is for your own personal, non-commercial use.

13.2 You agree that you will only use your account and the Website in an appropriate and lawful manner. You will not:

  1. areceive, access, or transmit any content which is obscene, threatening, racist, offensive, or otherwise unlawful;
  2. bknowingly transmit any content (including viruses) through the Website which will cause harm to the Website, the Promoter's IT systems, or other users;
  3. chack into, make excessive traffic demands, or otherwise engage in any behaviour intended to prevent others from using the Website.

13.3 You hereby agree to indemnify the Promoter against any costs, losses, damages, and expenses which the Promoter may suffer arising out of any claim or legal proceeding from a third party due to your unlawful or negligent use of your account or the Website.

1414. Electronic Communications and Technical Failures

14.1 No responsibility will be accepted by the Promoter for failed, partial, or garbled computer transmissions, or for any computer, telephone, network, or software malfunctions.

14.2 If, due to reasons of hardware, software, or other computer-related failure, or due to human error, a Prize is awarded incorrectly, the Promoter reserves the right to reclaim the Prize and award it to the correct Entrant, at its sole discretion and without admission of liability. The Entrant that has been incorrectly awarded the Prize will immediately return it to the Promoter.

14.3 The Promoter shall not be liable for any economic or other loss suffered by any person to whom an award has been incorrectly made, and no compensation shall be due.

1515. Payment Cancellations and Bank Chargebacks

15.1 If you submit an unjustified chargeback, you will be liable to pay the Promoter, within 7 days, the original entry fee plus any chargeback costs levied upon us by your bank.

15.2 In the event of an unjustified chargeback, we reserve the right to terminate your account on our Website.

1616. General

16.1 The Promoter may update these terms at any time. The latest version is on the Website.

16.2 Breaches of these terms may result in exclusion from this and future competitions.

16.3 The Promoter may void, suspend, cancel, or amend competitions due to circumstances beyond its control, refunding any entry fees paid.

16.4 These competitions are not sponsored or endorsed by Facebook.

16.5 These terms are governed by English law. Disputes fall under the courts of England and Wales.

16.6 Please print and keep a copy of these terms for your records.

16.7 Complaints Policy - In the event of a complaint, please contact us at complaints@duckdash.uk. We aim to respond to all complaints within 5 business days and resolve them within 28 days of receipt.

16.8 All intellectual property rights, including but not limited to, copyright, trademarks, and design rights in the Website and its content are owned by the Promoter.
